Welcome to Front Yard Fairways. These Terms of Service ("Terms") govern your access to and use of the Front Yard Fairways platform, mobile application, and services (collectively, the "Service") operated by Front Yard Fairways ("FYF," "we," "us," or "our").
Important: By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Be a verified resident of a building that partners with Front Yard Fairways, or an authorized guest of such a resident
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete registration information
We reserve the right to verify your eligibility and residency status at any time. Your access to the Service is contingent upon maintaining active residency at a partner building or valid guest status.
2. Account Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
3. Booking and Reservations
Making Reservations
The Service allows you to book golf simulator sessions at your building. All reservations are subject to availability and the booking rules established by your building and membership tier.
Cancellation Policy
You may cancel reservations according to the cancellation policy displayed at the time of booking. Late cancellations or no-shows may result in fees or restrictions on future bookings, as determined by your building's policies.
Check-In Requirements
You must check in for your reservation within the specified time window. Failure to check in may result in automatic cancellation of your session and may affect your ability to make future bookings.
4. Membership and Payments
Membership Tiers
We offer various membership tiers with different benefits and pricing. Membership benefits, pricing, and availability are subject to change. Current membership details are available within the Service.
Payment Terms
By subscribing to a paid membership or making purchases through the Service, you authorize us to charge your designated payment method. All payments are processed securely through our third-party payment processor (Stripe). You agree to pay all applicable fees and taxes.
Subscription Renewal
Paid memberships automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.
Refunds
Refund eligibility is determined on a case-by-case basis. Generally, subscription fees are non-refundable once the billing period has begun. Contact us for refund requests.
5. Acceptable Use
When using our Service, you agree to:
- Use the Service only for its intended purpose
- Treat the facilities, equipment, and other users with respect
- Follow all posted rules and guidelines at your building's golf simulator facility
- Not interfere with or disrupt the Service or other users' enjoyment
- Not attempt to gain unauthorized access to any part of the Service
- Not use the Service for any illegal or unauthorized purpose
- Not share your account credentials with others
- Not engage in any conduct that could damage, disable, or impair the Service
6. Guest Access
Members may bring guests according to their membership tier allowances. As a member, you are responsible for:
- Ensuring your guests comply with these Terms and facility rules
- Accompanying your guests during their visit
- Any fees associated with guest access
- Any damage or violations caused by your guests
7. Intellectual Property
The Service, including its content, features, and functionality, is owned by Front Yard Fairways and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRONT YARD FAIRWAYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Front Yard Fairways and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Assumption of Risk
You acknowledge that participation in golf-related activities involves inherent risks, including the risk of physical injury. You voluntarily assume all risks associated with your use of the golf simulator facilities and agree that Front Yard Fairways shall not be liable for any injuries or damages resulting from your participation.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations incurred prior to termination.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Cook County, Illinois.
15. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and Front Yard Fairways regarding the Service.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
